Marlène Ripoche Wintermans 19 Novembre 2019 19, avenue de Beauregard 13100 Aix-en-Provence, FRANCE To the attention of the Legal sections of the Embassy of France in the Netherlands, and the Embassy of the Netherlands in France: Dear Sir or Madam, This summer I discovered that Dutch criminal law does not take into account "sexual abuse" in articles of criminal law dealing with combating sexual discrimination in company statutes: Concerning the case in question: female heirs were blocked from "the natural rights accorded by their shares", and prevented from having access to the board of directors of the company, of which they still hold as many majority shares as their brothers- an even division of 51% of the shares of the Royal AGIO Cigars Company, in its best year worth nearly $1,700,000,000 in total revenue with about 2,000 employees. How was it possible to discourage said women from keeping 10% each of such a rich business? One of the theoretical fundaments of criminal law is that in order to prevent crime, the penalty should be sufficiently dissuasive as to discourage and disallow differences in treatment, thereby stopping criminal behavior before it starts. ... Unfortunately, from the symbolic violence of oral and written discrimination to concrete sexist violence including crimes of pedophilic and/or incestuous torture or rape, all the way to femicide crimes, the laws of the Netherlands in terms of company statutes is not adequate. In the case I present to you, State-sanctioned sexist statutes paved the way for the female heirs in question and their daughters to become victims of gender-based and/or sexual violence and rape crimes. I would prefer to avoid asking Europe for a condemnation of the Netherlands whose bad taste in awarding their royal distinction to the largest so-called "family" cigar company excluded Dutch women. It is clear that because the domination of men over women was institutionalized in our business, such a paradigm recognized neither gender-based violence nor even the sexual crime of rape. I will attempt to lay out the criminal consequences of gender discrimination in my family chronologically, and in doing so illustrate the need to prevent crime and physical violence by prohibiting the moral violence of sexual discrimination in all areas of human life. This phenomenon is epidemic as the victims in turn often become perpetrators in a system where the violence of sexism is banalized- in this case, AGIO Cigars. In my Dutch mother's family, boys and girls were raised differently: Separated early on from their brothers into different boarding schools, the girls were reserved for a future of marriage and raising children. Above all, their education did not include how to take responsibility for an organization; in this way they would not overshadow the privileged male heirs- their brothers reserved for management positions in the "family" business. Girls- unlike their brothers- were not worth a solid education since they were not to take on economic, social or political responsibilities. My mother however, from the age of seven, wanted to work in the family business in design and packaging. Her father dissuaded her from it, reserving her for the study of Fine Arts, to be followed by marriage. Her older sister was the first to challenge the gender discrimination of the AGIO Cigars statutes, especially at the death of her father when she staked a claim to her inheritance in the business. Their younger sister appears completely subordinated to the misogynist order. Is this the result of the torture and terrorism of my family's misogynist propaganda? My mother's older sister, my Aunt Marianne Wintermans, who avoided family intimidation as much as possible, explained to me that she had been the victim of pedophile incest by her own father Marcel Wintermans. But pedo-criminality is apparently invisible in a Catholic patriarchal "culture" inherited straight from ancient Roman law where the father retained the right to life or death over his own children. If you can go all the way, you can go halfway!... Having been a victim myself, it was not difficult to recognize what my aunts underwent at a very young age- the ease/ or lack of ease of their testimonies related to the level of their financial dependence on one or the other of their parents- either author and/or accomplice of moral/ sexist and/or physical/ sexual tortures. Marianne Wintermans suffered all her life from post-traumatic stress syndrome, especially manifested in the face of university exams, for fear of overshadowing her brothers, the male heirs. I recognize it because I unfortunately carry the same symptoms. Post-traumatic stress syndrome is an understatement. It is pure terror. As a sign of trust, my aunt gave me her family signet ring with the monogram of her parents (pedophiles), before dying at Christmas 2018. You can well imagine that I cannot wear the monogram of my misogynistic pedo-criminal grandparents except to testify, and to ask for post-mortem reparations for my aunt and her surviving sisters. I can only wear my aunt’s personal ring, the first known feminist rebel of our lineage. Her two other sisters, Josépha my mother and Carine my godmother (who were too weakened by domestic humiliation and violence from the sexist/sexual torture of the family and their in-laws) could not support her, nor dare to speak. Because of this, they were unable to claim their common rights to succession in the family business. I want to restore dignity to my aunt, who felt abandoned by her sisters, and who succumbed too soon to cancer, crushed by the ambient secrecy, and the profound terror of her father's torturous, incestuous pedophile crimes. I take up her torch and testify, specifically for her reparation and that of her two living sisters, hoping to free them from family oppression. Josépha Wintermans, my mother, was delivered by her own parents to their servants who raped her from the age of three to the age of about seven. She testified to this at my trial against the crimes of rape that were inflicted on me. She married a Frenchman Philippe Ripoche in order to flee the country and these femicide criminal tortures, although it was in fact her parents who married her off, paying her exchange with an advance from her inheritance, thus financing my father's MBA at Carnegie Melon Pittsburg. My mother is a broken personality, submissive to my father still 30 years after their divorce. She confuses love with fear and violence. She does not dare to hold him accountable for the advance which he still owes her from her own inheritance, that which served him as a scholarship in the United States. Neither does she claim the alimony that he refused to pay, even though she is left with no retirement in spite of having raised their 3 children. While my "father" travels around the world with impunity on a 14m catamaran (at least as expensive as what he owes my mother), she, ungrounded by the torture of her childhood, finds nothing unusual in the fact that I have to resort to picking through garbage in order to fill her refrigerator! My Dutch mother did not pass on her native language or nationality to her children in an attempt to forget the country where these sexist and misogynistic sexual tortures took place. I took 2 years of Dutch lessons at the European High School in Mol, Belgium when our mother returned there to live 2 years after her divorce from my father. This was provoked by the revelation of his having sexually assaulted my mother's younger sister. My father had always been unfaithful, but the discovery of the incestuous abuse of his sister-in-law was intolerable for my mother, who sanctioned him with his request for divorce. My father, trying to protect his reputation, became even more violent and tried removing the custody of their children from her to justify his misogynistic defamations. Carine Wintermans, my mother's younger sister and my godmother, victim of my father's sexual assault, was of course not defended by her incestuous family. However, she testified against him to prevent my mother from losing custody of us. At that time in France, divorces were only accorded in cases of wrong-doing, and so my father, trying to preserve his reputation, did all that he could to repudiate my mother, overwhelming her with false testimony. My mother, who was already suffering from post- traumatic stress syndrome (which endures to this day), continued to be persecuted but this time by her ex-husband. The moral harassment of my mother by my father continued until he turned to attack me when, at 17 years old, I revealed to him the rapes of which I had been the victim. Instead of finding support and comfort in my family, I found only rejection and humiliation. At another time or place I would have been stoned. And so I was banished from the social life of my father and the rest of his family. This man is as foolish as the wellman of Pagnol! My mother fell into a deep depression and made several suicide attempts. She was naturally not supported by her incestuous family. And for this reason, she could not find the strength to claim her inheritance rights upon the death of her father. After having suffered the terrorism of the criminal family tortures of her childhood, she was first sold off by her parents to be married, then repudiated and harassed by my father, only to then be finally pressured by the opportunistic greed and pride of her brothers- the "rightful" male heirs- into selling her shares. She was therefore not free in her decision, but under the pressure of the terrorism of her criminal family- all of this intensified by the continuing violence of her ex-husband- a sex offender eager to build a new reputation (after having soiled my mother’s) with a new marriage. Carine Wintermans, my mother's younger sister and victim of my father's violence, equally bereft of support from her incestuous criminal family, also fell into depression. Like my mother, she completely lacked the strength or the means to claim the inheritance due to her from the family business. My father's impunity in attempting to rape her fell perfectly into the family logic- institutionalized in the largest cigar company in the Netherlands where the complete domination of men over women resulted in a paradigm where rape cannot exist. Women are supposed to "always agree", and therefore their sexual consent is useless. The 3 sisters Marianne, Josépha and Carine Wintermans- direct heirs of AGIO, but victims of this systemic sexist terrorism, and therefore too broken to join together in solidarity, were opportunistically coerced by their brothers Adriaan and Jacques Wintermans, (apparently oblivious to all the misogynistic terrorism that their sisters had suffered since birth), into selling their shares of 10% each at the death of their father Marcel Wintermans. I suppose they were relieved to be able to satisfy their father's pride in honoring the tradition associated with seeing their family name furthered in entrepreneurial capital. The sexual discrimination of the AGIO heiresses strikes their descendants- my sister, Juliette Ripoche Wintermans and I, Marlène Ripoche Wintermans by legitimizing the misogynistic sexism of my father and his new wife, as well as that of our mother- each of whom found it completely normal to sacrifice my sister and I's education in order to benefit our brother's. It is AGIO Cigar's misogyny which gave weight and precedence to my father's violent sexism. In the divorce of our parents, or rather the repudiation of our mother, we- the children- were taken hostage by our father against her: in this my brother is both victim and beneficiary of my father's misogynistic sexist propaganda backed up by AGIO Cigars. To distract from his own sexual delinquency, our "father" applied for divorce for wrongdoing, making us believe that he sincerely wanted our custody. This was done in order to humiliate our mother by trying to separate us from her. Subsequently our "father" tore us siblings apart, by housing only our brother under his roof. He was to abandon his daughters to their mother at the divorce- in this way separating us from our brother- not surprisingly, with our mother's blessing. At the same time, he completed our mother's psychological destruction through defamation, and moral and physical harassment (he terrorized her behind the wheel), continuing the legacy of AGIO Cigars enacted by her parents when she was a child. In an attempt to conceal his abandonment, the "jealousy" of my father's new wife (lawfully obliged to show solidarity with our education) was perfidiously displayed. Full of hatred, and complicit in the imposture of her new husband, she would not share in our upbringing. My sister and I were therefore discouraged from higher education. I had wanted to follow the family tradition of attending elite schools, by studying medicine like my French grandmother Jacqueline Renault-Ripoche, or by doing a preparatory class in Decorative Arts. However my brother (who had been separated from his two sisters), was encouraged to prepare a scientific propaedeutic in Paris under my father's roof. Both my sister and I tried to come close to our father for our higher education, but we were rejected in an as politically correct way as possible! This is another example of how AGIO's legitimized sexual discrimination reached even into our higher education. It had been all too difficult to challenge the powerful sexist and misogynist propaganda dictated by AGIO cigars. A veritable Phoenix, it had risen its ugly head in many heinous if insidious ways. The fact that I was not successful in defending my right to adequate education can be understood by my lack of preparation and skills. I had been crushed in an outright fashion. Even as a young girl, my own mother had handed me over to the predatory sexual appetite of he who was to become my rapist. He was paid to tutor me. I have not been supported or defended by my father in any way- he for whom the rape of women does not even exist. This indignity is a result of the misogynistic sexist misinformation of his "education", mirrored by the misogynist climate inherent in my mother's equally patriarchal Roman Catholic family. Before my rapist was brought to trial, my sister Juliette Ripoche had never dared to speak of her own victimization at the hands of her first boyfriend. Olivier (son of the principal of the Font d'Aurumy de Fuveau Middle School) raped her in 1990 at their breakup. She will not dare to file a complaint given the ambient misogynistic terrorism legitimized by AGIO Cigars in my family. But she confirmed to me that she would testify if another person took him to court. However, she did testify at my trial about the way that our father ostracized our mother and we two daughters after having learned of the rapes of which I had been the victim. I, Marlene Ripoche Wintermans, At one time, I too had believed in the sophism of sexist superiority of men over women as propagated by AGIO. I was raised in it. When I dared to talk about feminism in the family, I was assured that male/female equality had been achieved and that it was futile to rebel. I wrongly put my trust in this. In this way, many men were then able to dominate me- even to the point of sequestering me. Instead of rebelling, I gave in to their threats as my parents had taught me to do. From the moment I asked for his support, my father (for whom moral and/or sexual harassment does not exist) harassed me with humiliating letters urging me to forget the violence I had been the victim of. This went on for 20 years. He also tried to destroy my reputation on the French side of the family. This man has divided to rule better, and tried all means to divert from his own crimes: known attempts to rape Carine Wintermans, sexual assaults on Philippe de Susa's girlfriend (hand to buttocks), as well as the numerous treacherous crimes against our immediate family- including scamming and robbing my mother, parental failings and the abandonment of his daughters, the moral harassment, humiliations, intimidation, and defamation of my mother and me, all the way to complicity with my rapist. Given the proven misogyny of my father whose sexual assault was tolerated by his victim's family (my surviving maternal aunt), I do not know if he would voluntarily pass on the necessary identification to cover my Dutch nationality. I denounce a savage and deregulated economy that destroys equality and therefore civilization! Here children and women were raped and then banished to satisfy the pride of cherished capital associated with a family name. Male chauvinist pride, greed and lust have also allowed for these crimes. What a waste! I would have preferred to tell another story, or at least write another one. A story where women and children were free and safe in a society where men would not be the predator of women or children. I denounce the complicity of the Wintermans «family»'s notary, and of the Eindhoven chamber of commerce in the Netherlands who drafted and hold these statutes of enterprise which are accessible to anyone, and therefore public. I also denounce the institutionalization and normative power of the Catholic religion regarding the obedience of women to their husbands- its doctrine legitimizing and underpinning the message of male domination over women in this family enterprise. Women's obedience is antithetical to consent. Obedience allows husbands to rape their wives and their children- left unprotected by their subjugated mothers. Without freedom and equality between men and women, sexual consent is a contradiction in terms! Without freedom and equality, violence is not recognized as reprehensible because it cannot exist. All these organizations are therefore sexist, misogynistic, and therefore unconstitutional. How long will it take to remember that we do not choose our sex at birth just as we do not choose our family or our heritage! My mother and her sisters did not choose to be born into a family whose large enterprise would provide a 10% inheritance to each. Nor did these discriminated and tortured sisters choose to stoke the lucre-lust of their brothers who had already been favored by their misogynistic and pedophile parents. I know that sexism is everywhere and that it only varies in scale depending on the place: In India and China, girls are still killed at birth, if not aborted in the absence of ultrasound gender identification! So many daughters have been exterminated that more males now exist than females even though nature produces the contrary! In these countries I would have already died- either murdered at birth, or stoned after having been raped! But couldn't we set an example in our own European territory by deterring the sexist violence of discrimination, and gender-based and sexual violence? The Netherlands allows companies to be virtual outlaw zones: law-free areas outside of civilization, outside of power and justice, areas that do not conform to the Dutch national constitution! These criminal enterprises are neither Dutch, nor European, nor even human because they do not respect the constitution, fundamental rights, or the Universal Declaration of Human Rights. Is the tradition of corporate capital succession from father to son at the exclusion of daughters written in stone until contradicted by law? Why doesn't penal law respect the first article of the Dutch constitution which lists the different terms of discrimination fought against according to the criteria of gender, sexual orientation, religion, country of origin... and others that I've forgotten... In fact, my question is how can unconstitutional criminal law exist? In fact in France, criminal law is very complete on this subject and respects the Dutch constitution from this point of view. What do I risk by pressing charges for this lack of constitutionality against a large company owned by my own family? Is Dutch criminal law unconstitutional to this day because no victims or witnesses have survived the consequences of this discrimination? How do I secure my experience as complainant? How many generations of women have been raped in the systemic transmission of businesses from father to son to the exclusion of women? How many others will you tolerate? How many female majority shareholders will you continue to exclude from the board of directors of their companies of which they own the majority of the shares? How long will the birthright of male primogeniture overrule the equal rights of the sexes when dealing with the line of succession in the Netherlands? I try to proceed with caution and avoid exposing myself unnecessarily. Do I have nothing to fear when it is all too easy for a large company to pay a hitman? I would prefer to avoid asking Europe for a condemnation of the Netherlands whose bad taste in awarding their royal distinction to the largest so-called "family" cigar company excluded Dutch women. This is a fine example of written and spoken gender discrimination in the public space, in the "private" space of the company, and the mixed sphere of a family- an institution destroyed by the breakdown of solidarity between its members. My argument is that every human organization made of citizens is never private. Deprived of fundamental rights? ... A private company deprived of equality... Private enterprise, a space of no rights?
